1. Acceptance of These Terms
These Terms of Service ("Terms") are a legally binding agreement between you and Elevated Health RX, LLC ("Elevated Health RX," "Elevated," "we," "us," or "our"). By visiting our website, clicking a call to action, completing intake, using checkout, creating an account, using a patient portal, enrolling in a subscription, contacting support, or otherwise using our services, you agree to these Terms.
If you do not agree, do not use the services. We may update these Terms from time to time. The updated Terms are effective when posted unless a later date is stated.
2. Not for Emergencies
If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.
Do not use the Elevated Health RX website, intake, checkout, support channels, or patient portal for urgent or emergency medical needs, including chest pain, difficulty breathing, fainting, stroke symptoms, severe allergic reaction, severe injection-site reaction, suicidal thoughts, or any rapidly worsening condition.
3. Our Role
Elevated provides non-clinical website, intake, checkout, administrative, subscription, support, and care-coordination services for an online anti-aging and longevity telehealth experience. Elevated is not a doctor, medical practice, pharmacy, or pharmacist. Elevated does not practice medicine, diagnose, prescribe, dispense medication, compound medication, or make clinical decisions.
- Clinicians: Independent licensed clinicians review your intake and determine whether treatment is appropriate. They may approve, deny, request more information, or recommend in-person care.
- Pharmacies: Licensed pharmacy partners, including Epiq Scripts and Rush Pharmacy where available and appropriate, compound, dispense, label, counsel on, and ship prescription medications after receiving a valid prescription.
- Patient portal: Intake, secure messaging, account access, documents, and related patient-portal functions may be supported by Dosable or similar vendors.
Your clinician-patient relationship, if one is established, is with the independent licensed clinician who evaluates you. Your pharmacy relationship is with the dispensing pharmacy.
4. Eligibility
To use the services, you must:
- Be at least 18 years old.
- Be physically located in the United States and in a state where the requested service is available when you complete intake or receive telehealth services.
- Provide truthful, current, and complete identity, contact, payment, shipping, and health information.
- Use the services only for yourself and not to obtain medication for another person.
- Maintain the confidentiality of your account and promptly notify us of suspected unauthorized access.
We may refuse, suspend, or terminate access if we believe you are ineligible, have provided inaccurate information, are seeking medication improperly, or have violated these Terms.
5. Intake, Telehealth, and Clinical Decisions
Completing intake or checkout does not guarantee a prescription. You agree to answer all intake questions truthfully and to disclose medications, supplements, allergies, medical history, pregnancy or breastfeeding status, cardiovascular history, immune conditions, cancer history, and any other information requested by the clinician.
A clinician may determine that the requested treatment is not appropriate, may request more information, may require a live visit, may require labs or outside records, may refer you to in-person care, or may decline to prescribe. Elevated does not control or override that clinical judgment.
Your use of telehealth is also governed by our Telehealth Consent.
6. Prescription and Compounded Medications
Prescription medications are available only after an independent licensed clinician determines they are medically appropriate and issues a valid prescription. Elevated does not sell or dispense prescription medication.
- Compounded drugs: Some anti-aging or longevity medications may be compounded for an individual patient. Compounded drugs are not FDA-approved, which means FDA does not review them for safety, effectiveness, or quality before marketing.
- Pharmacy fulfillment: The dispensing pharmacy is responsible for compounding, labeling, counseling, dispensing, and shipping in accordance with applicable law.
- Personal use only: You may not resell, transfer, share, or redistribute medication or supplies obtained through the services.
- Storage and handling: You are responsible for reading and following pharmacy instructions, temperature-control requirements, expiration dates, disposal instructions, and warnings.
- Adverse events: Contact your clinician, pharmacist, or emergency services as appropriate if you experience side effects, medication errors, worsening symptoms, or safety concerns.
7. Pricing, Payment, and Financial Responsibility
Prices are shown at checkout in U.S. dollars. You authorize us and our payment processor to charge your selected payment method for purchases, taxes, shipping, subscription renewals, replacement fees, and other amounts disclosed at checkout or in your account.
Elevated does not bill insurance, Medicare, or Medicaid. You are responsible for all charges. We do not guarantee HSA, FSA, insurance, tax, or reimbursement eligibility.
If a charge fails, we may retry the payment, pause fulfillment, cancel an order, or suspend a subscription. You remain responsible for amounts owed for products or services already provided.
8. Subscriptions and Auto-Renewal
Some products and services are offered as automatically renewing subscriptions. By enrolling, you authorize recurring charges until you cancel. Subscription billing, renewal, cancellation, price-change, and state-specific auto-renewal disclosures are governed by our Subscription Terms, which are incorporated into these Terms.
9. Cancellations, Refunds, and Shipping
Refunds and cancellations are governed by our Refund Policy. Shipping, cold-chain handling, address accuracy, lost packages, and damaged shipments are governed by our Shipping Policy.
Prescription medications generally cannot be returned or re-dispensed once shipped. If a clinician declines treatment before a prescription is sent to a pharmacy, your order will be cancelled or refunded as described in the Refund Policy.
10. Privacy
Our handling of personal information is described in our Privacy Policy. PHI may also be governed by our Notice of Privacy Practices and by notices from the applicable clinician, medical practice, pharmacy, or portal provider.
11. Communications Consent
You agree that we, clinicians, pharmacies, Dosable-supported portal services, carriers, and service providers may contact you by email, phone, text message, portal message, mail, or other reasonable methods for transactional, service, clinical, pharmacy, billing, subscription, shipping, support, safety, and legal purposes. Message and data rates may apply. You may opt out of promotional messages, but service and transactional communications may still be sent.
12. Prohibited Uses
You agree not to:
- Use the services for an unlawful, fraudulent, abusive, or harmful purpose.
- Provide false, incomplete, or misleading information, including health information.
- Impersonate another person or create an account for someone else without lawful authority.
- Seek medication for resale, transfer, diversion, or use by another person.
- Interfere with the website, intake, checkout, portal, security controls, or supporting systems.
- Use bots, scrapers, crawlers, or automated access without written permission.
- Reverse engineer, copy, modify, or misuse our technology, content, data, or branding.
- Upload malware, unlawful content, or content that violates another person's rights.
13. Intellectual Property
The website, content, designs, logos, copy, software, workflows, and other materials are owned by Elevated or its licensors and are protected by intellectual-property laws. You receive a limited, revocable, non-exclusive, non-transferable license to use the services for personal, lawful, non-commercial purposes.
14. Third-Party Services
The services depend on independent clinicians, pharmacies, Dosable-supported portal services, payment processors, carriers, hosting providers, communications vendors, professional advisors, and other third parties. Their own terms, notices, and policies may apply. Elevated is not responsible for third-party acts or omissions except where required by law.
15. Disclaimers
The services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Elevated disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, and uninterrupted operation.
Website content is informational and does not replace medical advice from a licensed clinician. No outcome, prescription, symptom improvement, lab result, weight, energy level, recovery improvement, or anti-aging result is guaranteed.
16. Limitation of Liability
To the maximum extent permitted by law, Elevated and its officers, directors, employees, contractors, agents, affiliates, successors, and assigns will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, goodwill, or business interruption, arising out of or relating to the services.
To the maximum extent permitted by law, Elevated's total liability for all claims arising out of or relating to these Terms or the services will not exceed the amount you paid to Elevated in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations. In those jurisdictions, liability is limited to the greatest extent permitted by law.
17. Indemnification
You agree to defend, indemnify, and hold harmless Elevated and its officers, directors, employees, contractors, agents, affiliates, successors, and assigns from claims, damages, losses, liabilities, costs, and expenses arising out of or relating to your misuse of the services, violation of these Terms, violation of law, false or incomplete information, account misuse, or infringement of another person's rights.
18. Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and your right to a jury trial.
You and Elevated agree that any dispute, claim, or controversy arising out of or relating to these Terms, the services, or products purchased through the services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring qualifying claims in small claims court.
Unless you and Elevated agree otherwise, arbitration may be conducted remotely or in Miami-Dade County, Florida. The arbitrator will apply Florida law, except where federal law or applicable consumer law requires otherwise.
You and Elevated may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, private attorney general, or representative action. You and Elevated waive the right to a jury trial to the fullest extent permitted by law.
You may opt out of arbitration by emailing legal@elevatedhealthrx.com within 30 days of first accepting these Terms. Your opt-out notice must include your full name, mailing address, account email, and a clear statement that you wish to opt out of arbitration.
19. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or mandatory consumer-protection law applies. Where court litigation is permitted, you agree to the jurisdiction and venue of state or federal courts in Miami-Dade County, Florida, unless applicable law requires otherwise.
20. Termination
We may suspend or terminate access to the services at any time if we believe you violated these Terms, created risk, failed to pay, used the services improperly, or if continued service is not legally, operationally, or clinically available. Termination does not relieve you of amounts owed for products or services already provided.
